The Past, Present, & Future of Police Reform Laws in Delaware

Issues regarding the use of force in policing, police misconduct, and lack of law-enforcement transparency have received national attention in recent years.  This panel will discuss these issues in Delaware.  The panel will begin with La Toya Holley, the sister of Anton Black, who died in police custody in Maryland on September 15, 2018.  One of the Maryland officers involved in Anton’s death was a former Delaware police officer who obtained employment in Maryland, after being acquitted of an assault on a Delaware man who was in his custody.  Panelists from the Delaware Office of Defense Services (Public Defender’s Office) and the Delaware Department of Justice will discuss the process for review of use of force cases and Garrity rights.  Additionally, the panel will highlight changes to Delaware’s laws over the past several years, including the use of body-worn cameras, changes to the self-defense statute, and the Law-Enforcement Officers’ Bill of Rights.

Let’s Just Call the Judge (or Not): Deposition Civility

Some tension during depositions is a natural product of the adversarial process; however, maintaining professionalism, civility, and ethical conduct at such times is essential to ensure evidence can be marshalled fairly by competing parties.  What happens though when a fact witness, expert witness, or opposing counsel interferes with that process by being uncooperative, nasty, or even belligerent?  Join experienced judges, practitioners, and disciplinary counsel for a discussion of best practices to encourage civility during depositions, the obligations of local counsel in pro hac vice cases, and when to call the court.
